Compliance Review Office

Jackson County's Compliance Review Office tracks and reviews contracts to ensure compliance in each phase with the areas of M/W/VBE utilization, payment of prevailing wage, and equal opportunity employment. The Office also monitors expenditures on Outside Agencies and non-competitively bid contracts.

Certificate of Compliance

A Jackson County Certificate of Compliance is required of all businesses and individuals wishing to do business with the County.

The Certificate of Compliance certifies the applicant has met the following requirements:

  1. Is not delinquent or otherwise owe any taxes to Jackson County, Missouri
  2. Attests and agrees to Chapter 6(PDF, 177KB) of the Jackson County Code which prohibits discriminatory employment practices and promotes equal employment opportunity by contractors doing business with Jackson County.

How to obtain a Certificate of Compliance:

  1. Go to the Compliance Review Office Portal to register a username and password.
  2. Complete application
  3. Click “Submit”

Timeline

The applications for Certificate of Compliance must be submitted to the Compliance Review Office 5 business days in advance of any other Jackson County deadline (bid response deadline, Agency funding application deadline, etc.) in order to guarantee the issuance of a certificate in advance of that deadline.

It is incumbent upon the vendor to obtain a Certificate of Compliance as required.

Prevailing Wage

The Prevailing Wage Compliance Program ensures that workers performing work on County public works projects are paid the prevailing hourly rate of pay. Payroll review and on-site visits ensure contractors are complying with the prevailing wage law of the State of Missouri as well as Chapter 19(PDF, 68KB) of the Jackson County Code.

The Jackson County Compliance Review Office (CRO) utilizes LCPtracker for Certified Payroll Reporting. Access to LCPtracker is granted through the CRO to those vendors holding Jackson County contracts with prevailing wage requirements.

Minority-Owned and Women-Owned Business Enterprise Program

Chapter 6(PDF, 177KB) of the Jackson County Code provides for the establishing of a program to diversify and expand subcontracting opportunities for minority-owned (MBE) and woman-owned (WBE) companies on Jackson County contracts. The Compliance Review Office reviews projects with a value of more than $50,000. If three or more MBE and/or WBE firms are identified in this review, then subcontractor utilization goals are assigned to the respective certification type.

Subcontractor Utilization Goals are set by the Compliance Review Office as a percentage of the overall contract value. For example, if an awarded contract has a value of $100,000 and the MBE utilization goal is 10%, then the value of the goal is $10,000. The prime contractor must identify one or more certified firms to fulfill one or more scopes of work for the contract. The subcontractors identified must be certified as an MBE or WBE firm in order for their participation to count towards the utilization goal.

Reporting Payments: Prime contractors are required to report payments received from Jackson County and payments made to all subcontractors on the 15th of every month.  Monthly reports are submitted online with the Diversity Compliance Management System.

    The Contractor Utilization Plan (CUP) is a list of MBEs, WBEs and VBEs that a prime contractor commits will be utilized, including its own participation as an MBE or WBE, if applicable. The CUP will list scopes of the work and the percentages of the contract value to be performed by each certified firm. CUPs are included in initial bid documents.     A CUP Modification Form is used to substitute and/or add a certified firm not previously listed on the Contractor Utilization Plan (CUP). Subcontractors may not be added or substituted without prior authorization of the Compliance Review Office and the using department. Failure to submit a CUP Modification Form prior to any changes in certified subcontractors on a project may cause termination of the executed contract for breach, the withholding of payment, and/or subject the Contractor to contract penalties or other sanctions.

    Good Faith Efforts are actions undertaken by a contractor to achieve MBE or WBE contract goals which, by their scope, intensity, and appropriateness to the objective, can reasonably be expected to fulfill the contract goals. When subcontractor utilization goals cannot be met, whether during the bid solicitation or throughout the duration of an awarded contract, a Good Faith Effort Form must be submitted to the Compliance Review Office. This form will provide an outline in which the contractor shall fully document its efforts to meet the assigned contract goals.

What is a certified MBE or WBE firm and how do I find one?

Certified Firm. A Certified Firm is one that has been accepted by the County as a certified MBE or WBE.

Minority Business Enterprise (MBE). A business, including a sole proprietorship, partnership, corporation, limited liability company, Joint Venture, or any other business or professional entity that is at least 51% owned by one or more Minority Individuals, performs a Commercially Useful Function and is a Certified Firm.

Woman-Owned Business Enterprise (WBE). A business, including a sole proprietorship, partnership, corporation, limited liability company, Joint Venture, or any other business or professional entity that is at least 51% owned by one or more Women, performs a Commercially Useful Function and is a Certified Firm.

Does Jackson County set goals for Veteran Business Enterprises?

Jackson County encourages and supports VBE utilization. Participation in the VBE program, outlined in Chapter 10(PDF, 126KB)  of the Jackson County Code, is voluntary.

What if my firm cannot meet the goals?

If goals cannot be met on a Contractor’s Utilization Plan in a bid solicitation or at any time throughout the duration of an awarded contract, a Good Faith Effort Form(PDF, 227KB) must be submitted to the Compliance Review Office. The Compliance Review Office is available to assist any contractor who needs help in identifying subcontractors, or with any other aspect of the compliance process.
